• Faced unreasonable and deliberately obstructive steps when attempting to cancel their membership.
The Defendants’ practices have caused widespread harm to consumers, including, but not limited to, unauthorized charges, undue financial loss, and pain and suffering.
Amazon’s practices may have violated Canadian consumer protection laws. Firstly, they failed to obtain informed consent before charging consumers for Prime membership. Secondly, they made it unduly difficult to cancel.
The U.S. Federal Trade Commission has already fined Amazon a civil penalty of US$1 billion dollars and ordered them to refund US$1.5 billion in consumer refunds. In addition, Amazon must change its practices in the United States. This includes adding clear and conspicuous disclosures regarding enrollment in Amazon Prime and declining enrollment, as well as enabling cancellation of an Amazon Prime subscription. All of this will be supervised by a third party.
