About the Class Action

ACTIS LAW GROUP is lead counsel in a proposed class action against Amazon concerning its Amazon Prime subscription practices.

The lawsuit alleges that Amazon knowingly enrolled millions of consumers in Amazon Prime without their informed consent through deceptive or misleading online interfaces. It also alleges that Amazon deliberately designed its cancellation process to make it difficult for consumers to end their subscriptions and continued to maintain those practices despite opportunities to simplify the process.

What Does the Lawsuit Allege?

The Plaintiff alleges that consumers were harmed by Amazon’s enrollment and cancellation practices.

According to the lawsuit, Class Members were either:

• Misled into enrolling in Amazon Prime through ambiguous or deceptive online interfaces, including default selections, pre-checked boxes, or unclear disclosures during the checkout process; or

• Subjected to unreasonable and deliberately obstructive steps when attempting to cancel their Amazon Prime membership.

The lawsuit further alleges that these practices caused widespread harm to consumers, including unauthorized charges, financial losses, and other damages.

Alleged Violations of Consumer Protection Laws

The action alleges that Amazon’s practices violated Canadian consumer protection legislation by:

– Failing to obtain consumers’ informed consent before enrolling them in and charging them for Amazon Prime; and
– Making it unnecessarily difficult for consumers to cancel their subscriptions.

Related U.S. Proceedings

The U.S. Federal Trade Commission has already fined Amazon a civil penalty of US$1 billion dollars and ordered them to refund US$1.5 billion in consumer refunds. In addition, Amazon must change its practices in the United States. This includes adding clear and conspicuous disclosures regarding enrollment in Amazon Prime and declining enrollment, as well as enabling cancellation of an Amazon Prime subscription. All of this will be supervised by a third party.
