About class actions
A class action is a legal procedure that allows a group of individuals, known as a “class”, to bring a claim together against one or more defendants. This collective approach is used when the issues faced by the individuals are so similar that it would be inefficient or impractical to pursue each claim individually. Instead, a representative plaintiff, or lead plaintiff, stands in for the class, representing the entire group and advocating for the common rights and interests of all class members.
Class actions are particularly valuable where the harm suffered by each individual may be relatively small in itself, but when considered collectively, the impact is significant. This often the case in consumer protection, securities fraud, data breaches, environmental disasters, or widespread corporate misconduct. By bringing together a large number of claims in a single lawsuit, class actions help ensure that the legal system can address large-scale issues more effectively with large-scale problems and provide access to justice for people who might not otherwise have the resources to bring and to pursue a lawsuit.
A class action involves several steps. First, the court must authorize or certify the class according to certain established criteria, which may vary depending on where the case is brought. Generally, the court must find that there are common questions of law or fact that warrant a class approach, that there is a viable cause of action, that there is a class of persons, and that the lead plaintiff can properly and adequately represent the class members. If the court decides to allow the class to pursue litigation, the class action will proceed with the lead plaintiff and their legal team representing the entire class. If the court rules in favour of the class, damages or settlements are distributed among class members according to a court-approved plan.
Class actions are a powerful tool for addressing widespread legal issues and holding defendants accountable. Not only do they provide a means for individuals to seek justice, but they also promote efficiency in the legal system by uniting related claims in a single lawsuit.
