About class actions
A class action is a legal procedure that allows a group of individuals, called the “class”, to collectively bring a lawsuit against one or more defendants. This collective approach is used when the issues faced by the individuals are so similar that it would be inefficient or impractical to pursue each claim separately. Instead, a representative plaintiff, or lead plaintiff, stands in for the class, representing the whole group and advocating for the common rights and interests of all class members.
Class actions are particularly valuable where the harm suffered by each individual may be relatively small in itself, but when considered collectively, the impact is significant. This situation is common in cases involving consumer protection, securities fraud, data breaches, environmental disasters, or widespread corporate misconduct. By uniting numerous claims into a single action, class actions help ensure that the legal system can address large-scale issues more effectively and make justice accessible for people who might not otherwise have the resources to take and to pursue litigation.
A class action involves several steps. First, the court must authorize or certify the class in accordance with established criteria that may vary depending on where the case is initiated. As a general rule, the court must determine that there are common legal or factual issues that justify a class approach, that there is a viable cause of action, that there is a class of persons, and that the lead plaintiff can properly an adequately represent the class members. Once the court decides to allow the class to pursue litigation, the class action proceeds with the lead plaintiff and their legal team representing the entire class. If the court rules in favour of the class, damages or settlements are distributed among class members according to a court-approved plan.
Class actions are a powerful tool for addressing widespread issues and holding defendants accountable. Not only do they provide a means for individuals to seek justice, but also promote efficiency in the legal system by uniting related claims into a single lawsuit.
