Uber Driver Sexual Assault Lawsuit Canada

Allegations Concerning Uber’s Safety Practices

There are allegations that as early as 2014, Uber became aware that Uber drivers were physically and/or sexually assaulting and raping female passengers. However, Uber has failed to implement meaningful safety measures that would help prevent, or at least mitigate, these crimes from occurring, including:

• Failing to require fingerprint-based background checks or cross-checking drivers against comprehensive criminal databases such as records maintained by the Royal Canadian Mounted Police (RCMP);
• Not implementing continuous monitoring systems to immediately detect when drivers are implicated in criminal activity;
• Not requiring driver interviews or adequate training regarding professional conduct, passenger safety, and appropriate behaviour;
• Maintaining policies where reports of sexual assault made by riders may not automatically be reported to law enforcement;
• Failing to require tamper-proof in-vehicle video monitoring or emergency alerts when suspicious ride activity occurs, such as a driver drastically deviating from a route or ending a trip while a passenger appears to remain in the vehicle;
• Failing to provide an option in the Uber app for riders who prefer to be matched with female drivers;
• Failing to adequately train drivers regarding sexual misconduct, harassment, boundaries, and passenger safety.

Uber’s Safety Reports

In its First U.S. Safety Report, Uber disclosed 5,981 reports of sexual assault in 2017–2018, including 464 reports of rape and 19 deaths caused by physical assault.

In its Second U.S. Safety Report, Uber reported 3,824 incidents in the five most severe categories of sexual assault in 2019–2020, including 141 reports of rape and 20 deaths caused by physical assault.

Following the first report, the California Public Utilities Commission fined Uber $59 million for failing to provide requested safety data. The matter later settled, with Uber agreeing to pay $9 million toward safety-related initiatives.

Status of the Uber Sexual Assault Lawsuits in the United States

Thousands of sexual assault lawsuits have already been filed in the United States against Uber.

These cases are currently consolidated in federal court in a multidistrict litigation known as In re: Uber Technologies Passenger Sexual Assault Litigation, which is being heard in United States District Court for the Northern District of California in San Francisco.

The litigation involves more than 3,000 claims brought by passengers who allege they were sexually assaulted by Uber drivers and that Uber failed to take adequate steps to protect riders.

Courts overseeing the litigation have allowed the core negligence and passenger safety claims against Uber to proceed.

In February 2026, the first major “bellwether” trial concluded with a jury ordering Uber to pay approximately $8.5 million in damages to a passenger who alleged she was sexually assaulted by an Uber driver. Uber has indicated that it intends to appeal the verdict.

Legal observers expect additional trials and potential settlements as the litigation continues.

Uber’s Marketing of Passenger Safety

Uber has consistently promoted its ridesharing platform as a safe transportation option, marketing its services to riders around the world, including throughout Canada. Critics argue that these safety claims were made despite growing reports of passenger assaults involving drivers using the platform.
