Not only did this data breach occur twice, but Dr. Schwartz did not inform his patients (or potential patients) in a timely manner.

Dr. Schwartz is a Beverly Hills celebrity plastic surgeon, who has appeared on television shows including “Botched” and “The Doctors”. He also has offices in Dubai.

Despite multiple warnings, Dr. Schwartz is alleged to have failed to maintain adequate cybersecurity, resulting in highly sensitive information being stolen and posted online.

The hacked data allegedly included patients’ names, phone numbers, home addresses, driver’s licence details, insurance information, credit card details, medical information, and, most alarmingly, photos and videos of patients in the nude or partially clothed, including images of them undergoing surgery while under anaesthesia.

Dr. Schwartz allegedly failed to notify patients of either the initial hack in September 2023 or a subsequent hack in March 2024 in a timely or appropriate manner, nor did he address the security weaknesses between the two incidents.

It was only when Dr. Schwartz’s patients discovered their sensitive and private data online that he allegedly informed them about the breach of their medical and private information.

Dr. Schwartz had ample warning of the need to protect his clients’ data, but failed to take the necessary steps to secure his network.

To date, hackers have published the personal information of dozens of Dr. Schwartz’s patients and are threatening to continue doing so until they receive a ransom.

The class action lawsuit consists of all Canadians who either consulted with or underwent surgery with Dr. Jaime S. Schwartz and who had their personal and private information was compromised.
